What personal information we collect

Depending on how you use ReferralCash, we may collect and process the following personal information:

Your identification and contact details, including your name, surname, email address, mobile number, company name and similar contact information.

Referral information, including referral links or codes, the identity and contact details of people referred through the platform, the status of referrals, and whether referral conditions have been met.

Course and enrolment information, including course interest, enrolment status, learner-related administrative information, and information needed to confirm whether a referral resulted in a valid enrolment.

Reward and payout information, where applicable, including information needed to validate and process referral rewards or incentives lawfully and securely.

Communications and support records, including messages, support requests, enquiries, responses and related records.

Technical and usage information, including IP address, browser type, device information, cookie identifiers, timestamps, pages visited, traffic source data, and interactions with referral links or forms.

Marketing and consent records, including your preferences, opt-ins, opt-outs, objections and related communication permissions.

How we collect personal information

We may collect personal information directly from you when you:
submit a form, enquiry or referral;
register interest in a course;
communicate with us;
participate in a referral campaign; or
provide information in connection with an enrolment or reward.

We may also collect personal information automatically through your use of the website, including through cookies and similar technologies.

In some cases, we may receive personal information from third parties, such as referral programme tools, enrolment systems, payment channels, service providers, or from a person who refers you through ReferralCash.

Why we process personal information

We process personal information for one or more of the following purposes:

to operate, manage and improve ReferralCash;
to record and administer referrals;
to verify referral activity and eligibility for rewards;
to process course enquiries and support enrolments;
to communicate with referrers, referred persons and learners;
to prevent fraud, abuse and misuse of the platform;
to process and administer valid rewards or payouts;
to maintain website security and performance;
to comply with legal, accounting, tax, audit and regulatory obligations; and
to conduct marketing where this is lawful and permitted under POPIA.

Lawful basis for processing

We process personal information only where we have a lawful basis to do so under POPIA. Depending on the circumstances, this may include where:
you have consented;
processing is necessary to conclude or perform a contract;
processing is required by law;
processing protects a legitimate interest of yours; or
processing is necessary for our legitimate interests in operating and securing ReferralCash, provided your rights and privacy are not unfairly prejudiced.

Referrals and information about other people

If you submit another person’s personal information through ReferralCash, including when referring someone to us, you confirm that you are authorised to provide that information to us and that you have taken reasonable steps to ensure that doing so is lawful.

You should only refer people where you are permitted to share their details and where they would reasonably expect to be contacted in connection with the referral, course information, or enrolment process.

We may use the information of referred persons to contact them about the referral, the relevant course or programme, and related enrolment or campaign administration.

Direct marketing

We may send marketing or promotional communications where permitted by applicable law. Where required, we will seek your consent before sending electronic direct marketing communications.

You may object to direct marketing at any time or unsubscribe from marketing communications by using the unsubscribe method provided in the communication or by contacting us at info@kapitalbiz.co.za.

Operational communications relating to referrals, enrolments, support, programme administration, reward validation or legal notices are not necessarily marketing communications.

Cookies and similar technologies

ReferralCash may use cookies, pixels and similar technologies to support website functionality, remember preferences, attribute referrals correctly, analyse traffic, measure campaign effectiveness, improve performance and help detect fraud or abuse.

These technologies may collect or store information such as IP address, browser type, device information, pages visited, dates and times of access, referral source information and user interactions.

You can usually control cookies through your browser settings. Disabling certain cookies may affect the operation of the site or the correct tracking of referrals.

Sharing personal information

We may disclose personal information to third parties where reasonably necessary for the purposes set out in this Privacy Policy, including to:
technology, hosting and infrastructure providers;
referral campaign and workflow providers;
enrolment administration providers;
payment processors or payout service providers;
analytics, communications and support providers;
professional advisers, auditors and insurers; and
regulators, law enforcement, courts or other persons where disclosure is required by law or necessary to protect rights or prevent fraud.

We do not sell personal information as a standalone business practice.

Third-party operator: ReferralHero

We use ReferralHero as a third-party service provider in connection with referral and enrolment workflow handling. ReferralHero may process referral-related and enrolment-related personal information on our behalf in order to administer referral campaigns, track referral activity, and support related platform functionality.

Where a third-party operator processes personal information for us, we take reasonable steps to ensure that the operator is bound by appropriate confidentiality, security and data protection obligations and processes personal information only for authorised purposes. Cross-border transfers

Some of our service providers or systems may store or process personal information outside South Africa.

Where personal information is transferred outside South Africa, we will do so only where permitted under POPIA, including where the recipient is subject to a law, binding rules or contractual terms that provide an adequate level of protection, where the transfer is necessary for the performance of a contract, where you have consented, or where the transfer is otherwise lawful.

Security safeguards

We take reasonable technical and organisational measures to secure the integrity and confidentiality of personal information in our possession or under our control, and to prevent loss, damage, unauthorised destruction, unlawful access, or unlawful processing.

Despite these measures, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

Retention of personal information

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, or for as long as required or permitted by law.

Retention periods may vary depending on the nature of the information and the reason for processing. We may retain referral, enrolment, reward, accounting, tax, support, dispute-resolution and security records for reasonable periods necessary to meet business and legal requirements.

When personal information is no longer needed, we will delete, destroy, anonymise or de-identify it where required or appropriate.

Your rights

Subject to POPIA and applicable law, you may have the right to:
request confirmation of whether we hold personal information about you;
request access to the personal information we hold about you;
request correction, updating or deletion of inaccurate, incomplete, misleading, excessive, out-of-date or unlawfully obtained personal information;
object, on reasonable grounds, to certain processing;
object at any time to the processing of your personal information for direct marketing;
withdraw consent where processing is based on consent;
request deletion or destruction of personal information where we are no longer authorised to retain it; and
lodge a complaint with the Information Regulator.

Some requests may be limited where we are legally entitled or required to retain certain records. Complaints

If you believe that we have processed your personal information unlawfully or in a manner that infringes your rights, please contact us first at info@kapitalbiz.co.za so that we can investigate and respond.

You also have the right to lodge a complaint with the Information Regulator of South Africa.

Chilren's information

ReferralCash is not intended for children who are not legally able to engage with our services or offers on their own. We do not knowingly collect personal information from children in a manner that would require parental or guardian consent unless such consent has been properly obtained.

Third-party Websites

ReferralCash may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties, and their processing of personal information is governed by their own privacy notices and terms.

We use ReferralHero as a third-party service provider in connection with referral campaign administration, referral tracking, and related enrolment workflow support. In the course of providing these services, ReferralHero may process certain website, campaign or referral activity data on our behalf.

Where lawful and appropriate, ReferralHero may use de-identified, anonymised or aggregated traffic and campaign performance data to support service improvement, campaign reporting, analytics, email campaign optimisation, fraud prevention, and similar promotional or platform performance activities. Such data will not intentionally identify you personally where it has been properly anonymised or de-identified in accordance with applicable law.

We do not authorise ReferralHero to use your identifiable personal information for its own independent marketing purposes except where such use is lawful, properly disclosed, and permitted under applicable data protection laws.

Where personal information is processed by ReferralHero on our behalf, we take reasonable steps to ensure that such processing is subject to appropriate confidentiality, security and data protection safeguards, including compliance with applicable privacy and data protection requirements, including POPIA where applicable.

There is one wording adjustment I recommend for legal safety. Instead of saying “POPIA compliant anonymised traffic data”, say “de-identified, anonymised or aggregated traffic and campaign performance data in accordance with applicable law”. That is more protective and less absolute.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted on ReferralCash with the revised effective date. Your continued use of the site after changes are posted will be subject to the updated policy.
